This Enforcement & Appeals Policy explains how Kingston Express enforces its Marketplace Seller Agreement and related policies, how sellers may appeal enforcement actions, and how seller funds are handled following suspension or termination.
This Policy applies to all third-party sellers on the Kingston Express platform.
1. PURPOSE #
Kingston Express enforces platform rules to:
- Protect buyers
- Maintain marketplace integrity
- Manage operational, financial, and legal risk
- Ensure fair treatment of compliant sellers
Enforcement actions are administrative decisions made to protect the Platform and do not constitute legal judgments.
2. ENFORCEMENT PRINCIPLES #
Kingston Express applies enforcement actions based on:
- Severity of the violation
- Frequency or pattern of behavior
- Risk to buyers or the Platform
- Seller history and cooperation
Not all violations require progressive enforcement. Serious or high-risk violations may result in immediate action.
3. ENFORCEMENT LADDER #
(WARNING → SUSPENSION → TERMINATION)
3.1 Warning (Corrective Action) #
A warning may be issued where:
- A violation is minor or first-time
- The risk is limited
- Corrective action is possible
Warnings may include:
- Written notice
- Required corrective steps
- Monitoring period
Failure to correct issues may lead to escalation.
3.2 Suspension #
A seller account may be temporarily suspended where:
- Violations persist after warnings
- Buyer experience is materially affected
- Policy breaches pose increased risk
- Verification or compliance issues arise
During suspension, Kingston Express may:
- Disable listings
- Pause payouts
- Restrict Dispatchment Services
- Continue holding funds to cover obligations
Suspension duration may be fixed or indefinite, depending on circumstances.
3.3 Termination #
A seller account may be permanently terminated where:
- Violations are severe
- Fraud, counterfeit, or unlawful activity is identified
- Buyer data is misused
- Repeated policy breaches occur
- The seller poses unacceptable risk
Termination may occur with or without prior warning where permitted by law.
4. APPEALS PROCESS #
4.1 Right to Appeal #
Sellers may appeal certain enforcement actions, except where:
- Termination is based on fraud or illegal activity
- Immediate action was required to prevent harm
- Law enforcement or regulatory involvement exists
4.2 Appeals Timeline #
Appeals must be submitted within:
- 14 calendar days of notice of enforcement action
Late appeals may be rejected.
4.3 Appeal Submission Requirements #
Appeals must include:
- Seller identification details
- Description of the enforcement action
- Explanation of why the decision should be reconsidered
- Evidence or corrective actions taken
Incomplete appeals may be rejected.
4.4 Appeal Review #
Kingston Express will:

Decisions following appeal review are final.
5. FUND HOLDS & PAYOUTS DURING ENFORCEMENT #
During warnings, suspensions, or termination, Kingston Express may:
- Withhold or reserve seller funds
- Delay payouts
- Deduct amounts for refunds, chargebacks, fees, or penalties
Fund holds are used to:
- Protect buyers
- Resolve outstanding obligations
- Manage financial risk
6. FUND RELEASE AFTER TERMINATION #
6.1 Post-Termination Review #
Following termination, Kingston Express may conduct a post-termination review to:
- Resolve open orders
- Process refunds or chargebacks
- Address disputes or compliance issues
6.2 Eligibility for Fund Release #
Seller funds may be released only after:
- All buyer obligations are resolved
- All fees, refunds, and chargebacks are deducted
- Any required waiting or risk-assessment period has elapsed
6.3 No Guaranteed Release Timeline #
Kingston Express does not guarantee a specific timeline for fund release following termination.
Funds may be retained where reasonably necessary to:
- Cover potential liabilities
- Comply with legal obligations
- Address ongoing investigations
7. NO WAIVER #
Failure by Kingston Express to take immediate enforcement action does not waive the right to act later.
8. RELATIONSHIP TO OTHER POLICIES #
This Policy operates alongside:
- Marketplace Seller Agreement
- Seller Policy Library
- Seller Fees, Commissions & Payout Terms
- Seller Returns & Customer Service Requirements
In the event of conflict, Kingston Express may determine the applicable policy.
9. POLICY UPDATES #
This Enforcement & Appeals Policy may be updated from time to time.
Continued use of the Platform constitutes acceptance of the updated Policy.
